What is included in Project Introduction File?

Regulation of;
a)the projects listed in Annex II,
b)in case of increasing capacity and / or in the expansion of the capacity of the projects that are in scope of the regulationor for projects outside the scope, threshold or above valued projects of Annex-II of the total increase capacity regulation are subjected to qualifying criteria.
Application and Process
The project owner, submits a petition for review that also includes three copies of the project presentation file with the proof of the information given on the project file and the attachmentswithin letter of commitment and authorized signatures list to the Ministry, as so according to Annex IV of the regulation, in order to ensure whether or not the Environmental Impact Assessment application is required.
The Ministry reviews the project presentation file that has been prepared for the project according to criteria in Annex IV of theRegulation within five days. In case of deficiencies in the file and documentation within the file, these missing information are asked to be completed by the project owner.
If the completed project file is not resubmitted within six months, project file will be returned and the application will be invalid.
If the ministry finds it necessary, they can examine or get the project site examined.
Decision of if EIA is required or not required
The Ministry examines and evaluates the projects that are related to the first article of theparagraphs (a) and (b) of Article 15 within the scope ofthe criteria in Annex IV of theRegulation.At this stage if the ministry finds it necessary, the project owner can be requested to give detailed comprehensive information about the project, provide equipment and ask to complete analysis, experiments and measurements at considered adequate institutions.
The Ministry reviews the project presentation file that has been prepared for the project according to criteria in Annex IV of theRegulation within five days.
The Ministry reviews and evaluates the project within fifteen business days and informs the project owner and the Governor about if the Impact Assessment is required or not. Then the Governor announces this decision to the public.
In case of the project with Impact “Assessment is not Required” decision is not began investment within five years, the Impact Assessment is not required decision becomes invalid.
In case of a project with “Impact Assessment is Required” decision.
For the projects given "Environmental Impact Assessment is Required" reasoned decision is notified to the Ministry. Accordance with Article 7 of the Regulation, "Environmental Impact Assessment is Required"decisioned projects are subjected to Environmental Impact Assessment. In this case, according to Article 8 of the Regulation if the project has not started on Environmental Impact Assessment process phase, application would be invalid.
